Terms and Conditions

Mostelle – Medical clinic

1. General information

This document sets out the general terms and conditions applicable to the sale of goods and services by S.R.L. MOSTELLE, through the online store shop.mostelle.md.
Any change to these terms is possible only with the express written agreement of both parties.

2. Definitions

  • Buyer: a natural or legal person who places an order through the shop.mostelle.md website.
  • Seller: S.R.L. MOSTELLE, with its registered office in Chișinău, 26 Mihai Eminescu St., fiscal code 1016600017466, bank account IBAN MD80ML000000002251619342, opened at BC “MOLDINCONBANK” S.A., bank code MOLDMD2X319, e-mail: info@mostelle.md, phone: +373 60100999.
  • Goods: cosmetic, dermato-cosmetic products or aesthetic consumables available for online purchase.
  • Services: aesthetic, body or rehabilitation treatments provided at the Mostelle clinic.
  • Order: an electronic document by which the buyer requests the delivery of products.
  • Contract: an order confirmed by the Seller.
  • Intellectual property rights: rights over the trademarks, logo, photo/video content and materials published on the site.
  • Specifications: technical and commercial descriptions of the goods displayed online.

3. Seller’s obligations

The Seller undertakes to provide products that comply with the specifications displayed on the site and with Mostelle quality standards.
All trademarks, photographs, descriptions and graphics on shop.mostelle.md are the exclusive property of S.R.L. MOSTELLE and may not be used without the company’s written consent.

4. Data confidentiality

The buyer’s personal data is used exclusively for processing and delivering orders.
MOSTELLE may contact the buyer for promotional purposes only with their consent.
Data is not disclosed to third parties, except delivery or payment partners, strictly for completing orders.
Personal data is processed in accordance with the Privacy Policy and Law of the Republic of Moldova No. 195/2024.

5. Payment security

  • All transactions are encrypted (SSL/TLS).
  • Card data is processed only through secure banking platforms.
  • shop.mostelle.md does not store bank card data.
  • The system checks the IP address and delivery address to prevent fraud.
  • Staff are trained periodically in data protection.

6. Penalties and delays

In case of a delivery delay, the Seller will announce a new estimated deadline.
Errors caused by incorrect information provided by the buyer may extend the delivery time by a maximum of 5 business days.

7. Payment

The details regarding the amount, method and term of payment are specified during the ordering process. Prices are expressed in Moldovan lei (MDL).
The tax invoice is issued at the time the products are shipped.
Accepted payment methods:

  • bank card (Visa/Mastercard);
  • bank transfer (for legal entities).

8. Risk and responsibilities

Responsibility for the risk of loss or damage to the products passes to the buyer from the moment of handover to the courier.
The products are packaged appropriately and delivered only within the territory of the Republic of Moldova.

9. Order acceptance

Products are considered accepted at the moment they match the confirmed order.
In case of non-conformities, the Seller undertakes to remedy them or replace the product, in accordance with the legislation in force.

10. Warranty

Products sold by Mostelle benefit from the quality warranty provided by the manufacturer.
In the absence of a separate warranty certificate, the tax invoice or the delivery document constitutes proof of warranty.

11. Right of return (withdrawal)

As a consumer, you have the right to return products purchased at a distance within 14 calendar days of receipt, without giving a reason, in accordance with Law No. 105/2003 on consumer protection.
Returned products must be of appropriate quality, in their original condition, unused and with intact packaging/seal.
For hygiene reasons, opened cosmetics and consumables cannot be returned, as provided by law.
The return shipping cost is generally borne by the buyer, except where the delivered product is non-conforming, wrong or damaged.
To return a product, contact us at info@mostelle.md; the refund is made within the term provided by law, after we receive the returned product.

12. Transfer of ownership

Ownership of the products passes to the buyer upon full payment.
Couriers are not authorized to allow the parcel to be opened before payment, for security and hygiene reasons.

13. Liability

The Seller is liable for the obligations assumed in the relationship with the buyer and for the contractual partners involved in the sale and delivery process.

14. Force majeure

Neither party shall be liable for the non-performance of contractual obligations in the event of force majeure (an unforeseeable, unavoidable and uncontrollable event), in accordance with the legislation of the Republic of Moldova.

15. Applicable law and jurisdiction

This contract is governed by the legislation of the Republic of Moldova.
Any dispute arising between S.R.L. MOSTELLE and the buyer shall be settled amicably or, failing that, by the competent courts of Chișinău.
